Terms of Use
These terms are the agreement between you and the operator of Boha, an individual in Quebec, Canada (“we”, “us”). They apply to the Boha apps for iOS and Android and to its server. By using the app, you accept these terms. Our Privacy Policy explains how we handle your personal information.
1. Using Boha
- You can browse, search, open recipes and cook without an account.
- To create, import, save, like, comment, follow, share, report or block, you need an account.
- You must be 16 or older to create an account. When you create an account, you confirm that you are at least 16.
- Keep your sign-in secure. You are responsible for what is done with your account.
- Give true information, and do not pretend to be someone else.
2. Your content
“Your content” means the recipes, photos, notes, comments, profile details and other material you add to Boha.
You keep ownership
You keep all rights you have in your content. We do not claim ownership of it.
Licence to us
You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, resize, format and display your content, only to run Boha and only as your settings allow. For example, we show a public recipe to everyone, an unlisted recipe to people with its link, and a private recipe only to you. This licence ends when you delete the content or your account, except for copies in backups that expire on their own schedule.
Your rights to what you post
You must have the right to post or import everything you add. Recipe ideas and ingredient lists are often free to use, but the words, photos and videos of other people are usually protected by copyright. Do not post someone else’s text or photos without permission. A recipe you import from a link can’t be made public in the app. It stays private or unlisted, with credit to its source. A recipe you import from a photo or pasted text can be made public only if it is your own recipe. By making a recipe public, you confirm that you wrote it or have the right to share it.
Recipes published by the operator
Some public recipes are published by the operator from the operator’s own blog. The operator owns their text and photos.
Rules
Do not post or send content that:
- infringes someone’s copyright, trademark, privacy or other rights;
- is hateful, harassing, threatening, sexually explicit or violent;
- is spam, advertising or misleading;
- encourages dangerous food practices or is otherwise unsafe;
- is illegal in Canada or Quebec.
Do not try to break, overload or get around the limits of the service, or to access other people’s accounts or private recipes.
Zero tolerance. We do not tolerate objectionable content or abusive users. We remove such content, and we remove users who post it or who abuse others.
3. Block and report
- Block: you can block any user. You and that user will no longer see each other’s recipes, comments or profile, and cannot follow or comment on each other. To unblock, tap the profile button at the top of the Home screen to open You. Under Account, choose Blocked Users.
- Report: you can report a recipe, a comment or a profile for spam, offensive content, copyright, unsafe content or another reason, with an optional note. We review reports and act within 24 hours. We remove content that breaks these terms, and we remove users who break them.
4. Removing content and copyright notices
We may hide, make private or remove any content, and limit or close any account, that we believe breaks these terms or the law.
Copyright notice. If you believe content on Boha infringes your copyright, email support@boha.starb.ca with:
- your name and how to contact you;
- the work you own;
- the link or name of the recipe, comment or profile you believe infringes it;
- a statement that you own the rights or act for the owner, and that the information in your notice is accurate.
You can also use Report with the Copyright reason in the app. We will review the notice, remove or make the content private when it appears to infringe, and tell the person who posted it when we can. That person can reply to us if they believe we made a mistake. We follow the notice process required by law.
5. Recipes, allergies and food safety
Recipes on Boha come from users, from websites and from AI that turns imports into recipes. They are provided “as is”.
- We do not check recipes. They can contain errors, including errors made by the AI when it reads an import. Always check an imported recipe against its source.
- Allergies: ingredient lists may be incomplete or wrong. If you or anyone you cook for has an allergy or a dietary restriction, check every ingredient and label yourself.
- Food safety: follow safe food handling. Cook meat, poultry, fish and eggs to safe internal temperatures, and store food correctly. Times and temperatures in a recipe are guides only.
- Be careful with knives, heat, hot oil and kitchen equipment. Cooking timers in the app are an aid, not a safety device.
- Recipes are not medical or nutrition advice.
6. Imports and Boha Pro
Free imports
Each account gets 40 free imports in total (text, link or photo). A failed import does not count.
Boha Pro
After the free imports, you need Boha Pro to keep importing. Boha Pro is a subscription or a one-time lifetime purchase. Everything else in the app stays free.
- Lifetime purchase: you pay once. It does not renew.
- Price and period: the price, currency and billing period are shown in the App Store or Google Play before you buy. Taxes may apply.
- Payment: Apple or Google charges your store account when you confirm the purchase.
- Auto-renewal: the subscription renews automatically at the end of each period, at the same price, unless you cancel before it renews.
- App Store: cancel at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before the period ends.
- Google Play: cancel any time before the renewal date. Google charges the renewal on that date.
- Cancel: manage or cancel in your App Store or Google Play account settings, or from Manage Subscription on the You screen, under Imports. Cancelling stops the next renewal. You keep access until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
- Restore purchases: use Restore Purchases on the You screen, under Imports, to restore an active subscription or a lifetime purchase on a new device while signed in to the same account.
- Refunds: refunds are handled by Apple or Google under their rules. This does not limit any right you have under the law.
- Price changes: the store tells you before a price change and, where required, asks for your consent.
- Unlimited imports: with Boha Pro, you can import as many recipes as you want. If the service has too much load, we can pause imports for everyone for a short time.
Apple and Google are not responsible for Boha or its content. If you use the iOS app, Apple’s standard end user licence agreement also applies, and Apple can enforce these terms as a third-party beneficiary.
7. Changes to the service
We may change, add or remove features. We may stop the service. If we stop it, we will tell you in the app at least 30 days before, when we can, so you can copy your recipes. If an active paid subscription is affected, you may be entitled to a refund under the law or the store’s rules.
8. Ending your use
- You can stop using the app at any time, and delete your account: tap the profile button at the top of the Home screen to open You. Under Account, choose Delete Account. Deleting your account deletes your content, as described in the Privacy Policy.
- We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires it. When we can, we will tell you why.
9. Limitation of liability
We run Boha as an individual, with care, but we cannot promise it will always be available or error-free.
To the extent the law allows, we are not liable for:
- loss caused by relying on a recipe’s errors or omissions;
- content posted by other users;
- interruptions, lost data, or indirect loss.
Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, such as liability for bodily or moral injury caused to others, or for intentional or gross fault. If you are a consumer in Quebec, you keep all rights under the Quebec Consumer Protection Act and the Civil Code of Québec, and no part of these terms applies to the extent it would limit those rights.
10. Governing law
These terms are governed by the laws of the province of Quebec and the federal laws of Canada that apply there. The courts of Quebec have jurisdiction. If you are a consumer, this does not remove your right to go to the courts of the place where you live.
11. Changes to these terms
We may update these terms. We notify you of every change in the app at least 30 days before it applies. The notice shows the new text, the old text, and the date the change applies. If you do not agree, you can refuse the change by closing your account, at no cost, before that date. We also change the date at the top of this page.
12. General
- If a part of these terms is not valid, the rest stays in force.
- If we do not enforce a part of these terms, we do not give up the right to do so later.
- The French version of these terms is equally available. Les versions française et anglaise ont la même valeur.
